OVERVIEW

Welcome to Project-X. The terms "we", "us" and "our" refer to Project-X. Project-X operates this store and website, including all related information, content, features, tools, products and services (the "Services").

These Terms of Service ("Terms"), together with our Privacy Policy and Refund Policy, describe your rights and responsibilities when using the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction. You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, or assign your account to any other person.

SECTION 2 – OUR PRODUCTS

We make every effort to accurately represent our products. However, colours and appearance may vary depending on your device and display settings. We do not warrant that product appearance or quality will meet your expectations or match exactly what is depicted on screen. All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities at our sole discretion.

Our products are simulation hardware accessories designed for use with flight simulation software. They are not certified aviation equipment and are not intended for use in real aircraft or safety-critical applications. Use of our products in any real-world aviation context is entirely at your own risk.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Project-X reserves the right to accept or decline any order for any reason at its sole discretion. Your order is not accepted until Project-X confirms acceptance and payment is processed.

Project-X may be unable to accommodate cancellation requests after an order is accepted. In the event we decline or cancel an order, we will attempt to notify you via the contact details provided.

Returns and exchanges are governed exclusively by our Refund Policy: 

You confirm that purchases are for personal or household use only and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as confirmed in your order confirmation email. Posted prices do not include applicable taxes, shipping, customs, or import charges unless expressly stated.

You agree to provide accurate and complete payment information. You represent that you are authorized to use the payment method provided and that charges will be honored by your payment provider.

SECTION 5 – SHIPPING AND DELIVERY

All delivery time frames are estimates only and are not guaranteed. Project-X accepts no liability for shipping or delivery delays, whether caused by manufacturing lead times, shipping carriers, customs processing, weather, or any other circumstances beyond our control.

Once a product is transferred to the carrier, title and risk of loss passes to you. Any claims for lost or damaged shipments must be directed to the relevant carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services — including product designs, images, text, graphics, logos, and branding — is the intellectual property of Project-X and is protected by applicable copyright, trademark, and intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. All rights not expressly granted are reserved by Project-X.

SECTION 7 – THIRD-PARTY TOOLS

We may provide access to third-party tools or services as part of the Services. These are provided "as is" and "as available" without any warranties or endorsement. We accept no liability whatsoever arising from your use of any third-party tools. Use of such tools is entirely at your own risk.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing third-party sites is entirely at your own risk. Complaints regarding third-party products or services must be directed to the relevant third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Project-X is powered by Shopify, which enables us to provide the Services. However, all sales and purchases are made directly with Project-X. By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and Project-X, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims arising from your transactions with Project-X.

SECTION 10 – PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy.

By using the Services, you confirm that you have read and understood our Privacy Policy. Information submitted through the Services may be shared with Shopify and third-party service providers as described in our Privacy Policy.

SECTION 11 – FEEDBACK

By submitting any feedback, reviews, suggestions, or ideas to us, you grant Project-X a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute such content for any purpose, including commercial use, without compensation to you. We are under no obligation to maintain confidentiality of, compensate for, or respond to any feedback.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct any errors, inaccuracies, or omissions in product descriptions, pricing, promotions, or availability at any time without prior notice, including after an order has been submitted. We accept no liability for any loss arising from reliance on inaccurate information.

SECTION 13 – PROHIBITED USES

You may only use the Services for lawful purposes. You must not use the Services to: violate any applicable laws or regulations; infringe intellectual property rights; transmit harmful, offensive, or misleading content; spam or phish; scrape or extract data using automated tools or AI agents; or interfere with the security or operation of the Services.

We reserve the right to suspend or terminate your access at any time without notice if we determine you have violated these Terms.

SECTION 14 – AUTOMATED AGENTS

Any software or automated agent accessing the Services must identify itself in all HTTP/HTTPS requests, must not mimic human behavior, must not circumvent CAPTCHAs or security measures, and must comply with any restrictions we impose. We may block or limit automated access at any time without notice and accept no liability for any resulting disruption.

SECTION 15 – TERMINATION

We may terminate your access to the Services at any time, without notice, at our sole discretion. Upon termination, you remain liable for all amounts due. Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

OUR PRODUCTS ARE SIMULATION ACCESSORIES ONLY. WE MAKE NO WARRANTY THAT THEY WILL PERFORM TO ANY PARTICULAR STANDARD OR BE COMPATIBLE WITH ANY SPECIFIC SOFTWARE VERSION OR HARDWARE CONFIGURATION.

SECTION 17 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, PROJECT-X, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WHERE LIABILITY CANNOT BE EXCLUDED BY LAW (INCLUDING UNDER EU CONSUMER PROTECTION REGULATIONS), OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

SECTION 18 – INDEMNIFICATION

You agree to indemnify and hold harmless Project-X, Shopify, and their respective affiliates, officers, directors, employees, agents, and licensors from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any applicable law or third-party rights; or (3) your use of the Services.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms does not constitute a waiver. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Project-X regarding the Services and supersede all prior agreements.

SECTION 21 – ASSIGNMENT

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign or transfer these Terms at any time without notice.

SECTION 22 – GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Cyprus.

SECTION 23 – CHANGES TO TERMS

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
